Mediation Model
|
The
Center is a non-profit educational institute dedicated to integrating
principles of mediation into the practice of law and the resolution of
legal disputes. Since its founding in 1981, the Center has worked to

conducted introductory and advanced training programs for thousands of
lawyers and other professionals in the United States. Center trainers
also regularly conduct trainings in collaboration with other
educational institutions, including at Harvard's Program of Instruction
for Lawyers and the World Intellectual Property Organization. Since
1990, the Center has also trained mediators in Germany, Austria,
Switzerland and Israel. The Center's model of mediation is used
increasingly in legal disputes in commercial, family and other legal

“This
revolutionary book shows how through
mediation parties can escape the trap of conflict rather than remain
ensnared
within its grasp at enormous cost to themselves and others. The authors
demonstrate how mediators, and lawyers, can support parties to work
together
effectively in ways that deeply respect their humanity. Through the
telling of
ten riveting stores of actual commercial mediations, the principles and
methodologies of the understanding-based approach come alive. In so
"challenging conflict," the authors also challenge the conflict
resolution field to reach for more.”

Excerpt
from Saving the Last Dance: Mediation through
Understanding, a mediation training video illustrating the
Center's Understanding Based Model of mediation. By: Gary J. Friedman,
Jack Himmelstein, and Robert H. Mnookin
In collaboration with the Harvard Program on Negotiation, the Center
for Mediation in Law, has produced "Saving the Last Dance: Mediation
Through Understanding". This video demonstrates our mediation model as
applied to a highly charged business dispute. Focusing on a conflict
between a dance company and its recently discharged choreographer,
which raises intellectual property and employment issues, the video
alternates between excerpts from the mediation itself and an
educational commentary.
